Tracy Alan Saxe acted as co-chair of this conference which gave in-depth, practical analysis of the most vital issues in construction litigation, including topics ranging from policy language interpretation and faulty workmanship to weather damage and failure to disclose.
Kevin P. Dean’s Coverage for Contractual Risk Transfer and Additional Insured Issues presentation explicated pressing issues such as: coverage for your contractual indemnity obligation, defense obligation arising from the Additional Insured relationship, duration of coverage and completed operations, other insurance and priority of coverage, new fault based forms, disconnect between contract requirements and endorsements available, and effect of state legislation. Mr. Dean collaborated with Beth Bradley of Tollefson Bradley Ball & Mitchell for this presentation.
Jeffrey J. Vita’s joined Linda Foster of Weissman, Nowack Curry & Wilco to present a Mock Summary Judgment Argument, which discussed the question of priority of coverage for a general contractor in an additional insured context where the subcontractor and the general contractor have competing coverage. Counsel for each party presented summary judgment arguments on this issue and participated in the following discussion of the effectiveness of summary judgment as a tool and its most appropriate use.
Tracy Alan Saxe also moderated Proactive Preparation for Effective Mediation, joining forces with William Noonan of Structure Tone, Todd Schweitzer of St., Paul Travelers, and Robert Black of Mehaffy Weber. This presentation got to the heart of the parties, preparation and legal issues involved in effective mediation on a client’s behalf.
