Did you know that SDV also has experience fighting for the rights of life insurance policy holders?
It has often been said that the only certainties in life are death and taxes. In preparation for the former, many prudent individuals acquire life insurance to ensure some financial security for their loved ones after they have passed on. The fact that everyone dies makes life insurance a unique product. Other types of coverage, such as automobile and property insurance, afford protection against risks that are uncertain (or even unlikely) to happen (e.g. a car accident or a building fire.)
The risk (or gamble) being undertaken by a life insurer is that the insured will pass on when the coverage is in effect. To reduce this risk, insurers often limit the term of the insurance (such as to age 80) or will raise premiums dramatically after the insured reaches a certain age (upwards of 500%). As insureds begins to reach their “golden years”, or contract serious health conditions, it is not uncommon for disputes to arise over compliance with (and the meaning of) certain policy terms, including payment dates, increase in premiums rates, reinstatement guidelines, and notice of cancellation requirements.
As a practice devoted to insurance coverage law, we have encountered and litigated many of these issues for our individual clients in order to maximize their insurance recovery. For illustrative context, click here to read a recent decision where SDV successfully opposed a motion for summary judgment involving a dispute over late premium payments.
